What applies — and when
- 2 Feb 2025 — Prohibited practices live (Art. 5): social scoring, untargeted facial scraping, emotion inference at work or school.
- 2 Feb 2025 — AI-literacy duty in force (Art. 4); enforcement activated Aug 2026.
- 2 Aug 2026 — Transparency duties LIVE (Art. 50(1)/(3)/(4)): tell people when they talk to an AI, label AI interactions, disclose deepfake-style content.
- 2 Dec 2026 — Grace period ends for machine-readable marking of synthetic content (Art. 50(2)).
- 2 Dec 2027 — Annex III high-risk regime applies (recruitment, credit, education and similar uses).
- 2 Aug 2028 — High-risk AI embedded in regulated products (Annex I route).
SME penalty cap: as an SME you face the lower penalty band — up to €15 million or 3% of worldwide annual turnover (whichever is lower), rather than the €35 million / 7% maximum for the most serious violations.
